a) BUYIT247, buyit247.net a trading name of PC Interworks Ltd b) PC Interworks Ltd, PC Interworks, PCI, us, our - PC Interworks Ltd and any associated or subsidiary companies identified as the product vendor on your invoice. c) You, the consumer, the customer - a person or company buying products or services from PC Interworks and the other party to this agreement d) Product, goods - merchandise offered for sale by PC Interworks e) Software, Third Party Software - all software owned by or licensed to the Customer from a third party owner and which comprises part or all of the Products f) Website, Site the site operated by PC Interworks Ltd with the URL www.buyit247.net or www.buyit247.com
2) GENERAL a) The following terms and conditions apply to all transactions which are processed by PCI either online or by any other form of communication and form part of the contract between us. Please read them carefully and print a copy for future reference. b) Your use of this site indicates your acceptance of these terms and conditions. c) To order goods using this website you must be at least 18 years of age and accept delivery within the UK. d) These terms and conditions do not affect your statutory rights.

4) WHAT WE SELL PC Interworks was established in 1995 as an employee sales specialist but, through continual development of the business, is now one of the leading providers of specialist refurbishment and resale services to the UK computer industry. We operate from purpose built premises in North Staffordshire and repair and refurbish, to exacting manufacturer standards, tens of thousands of PCs and Notebooks every year. We then offer these products, which we call Grade 2, for sale to our customers at substantial discount from the High Street price allowing you, the consumer, top quality products at top value prices. As well as Grade 2 products, we also carry a range of brand new IT products at competitive prices.

6) OFFER & ACCEPTANCE a) Any proffer of products or services obtainable via our website or by electronic mail solicitations are, for the purposes of the English Law, explicitly defined as invitations to treat and not offers. b) PCI reserves the right to refuse orders on any basis. No contract is created until we have accepted your order. In the event a product is listed at an incorrect price due to a typographical error or error in pricing information received from our suppliers, we will not process your order and will instead alert you immediately to the actual price of the goods. You will then have the option to proceed at this updated price. We will only process any such order with your explicit authority.
7) ACCURACY OF PRODUCT INFORMATION AND THE DESCRIPTION OF GOODS a) Product specifications, images and other information published on our website have either been made accessible by suppliers, manufacturer's, publications, publicists, or been gathered from public-domain sources. b) The intention of PCI is that all information on the website should be as accurate and up to date as possible. We cannot guarantee the reliability or the accuracy of the information contained within its pages. Actions taken by the user of the website are the responsibility of the individual. Images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from the manufacturer's brochures or their websites. c) All accessories supplied with a product are subject to upgrade or change at the manufacturers discretion. We will supply the product as supplied to us by the manufacturer.
8) PRICES a) All prices quoted are in £ Sterling and are subject to stock availability. b) Prices on this site are shown both excluding and including VAT. Where VAT is applicable, it will be charged at the prevailing rate which is currently 17.5%. c) The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices or the imposition of any taxes or duties. d) Quotations are only valid in writing and during the period that they state. If no time is stated the quotation will be valid for a period of 7 days and is subject to stock availability.
9) AVAILABILITY OF GOODS a) All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for them and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods. b) On occasion goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. c) If PCI or our suppliers are temporarily out of stock, we will notify you of this position and you should allow up to 14 days for despatch of the goods. For delays of more than 14 days, you will have the right to cancel the order and we will refund any money paid by you for the goods.
10) MAKING A PURCHASE a) If you wish to make a purchase, just browse our Catalogue, click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Checkout Now" and you will be asked for your personal and credit card details that we need to be able to satisfy the order. b) If you dont wish to place an order on line, simply ring our sales order desk and speak to one of our sales representatives.
11) PAYMENT METHODS a) PCI accepts payment as follows: i) Cash - Sterling currency tendered in person (subject to the limits imposed under The Money Laundering Regulations 2003, the Proceeds of Crime Act 2002 (money laundering) and sections 18 and 21A of the Terrorism Act 2000.) Do not send cash through the post or by courier. ii) Postal/Money Order - Only UK Sterling Postal Orders accepted. Please cross the order with A/C Payee Only Please note that we cannot dispatch the goods until payment has been cleared which can take up to 10 working days. iii) Credit/Debit Cards - We accept Visa, MasterCard, Switch and Delta. Surcharges for credit cards are not normally made but we reserve the right to do so, on certain orders. (Switch/Delta and other debit cards excepted) iv) Cheques - Orders paid for by cheque will not be despatched until payment has been cleared which can take up to 10 working days. Personal cheques may be cleared immediately provided a valid cheque guarantee card number and expiry date are written on the reverse of the cheque. Business cheques may be subject to a surcharge for immediate clearance. Special presentation is available for £25.00 plus VAT and will clear a cheque in 48 hours. A building society cheque or bankers draft will be cleared immediately provided it is tendered during business hours. Foreign cheques must be drawn on a UK Bank in sterling. v) Bank Transfer - We can accept CHAPS & BACS transfers. Please contact our accounts department before paying by this method. 12) CREDIT CARD SECURITY a) On the order you must provide us with your exact billing address and telephone number, the address and phone number your credit card holder has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received. b) For extra security we ask for your credit cards "CVV" number. The CVV number (Card Verification Value) is the last 3 digits of the number written along the signature strip on the reverse of your card. c) All credit card numbers are taken and encrypted behind a Secure Socket Layer (SSL). They are only decrypted after they reach us. They are not held in clear text on any web site. The 'golden padlock' symbol will appear in your browser when you reach the credit card input stage of the checkout. This is your assurance of security. All credit card details are erased from our system & files once your order has been processed & despatched.
13) SHIPPING & HANDLING a) Our aim is to deliver all goods ordered within 10 working days. Delivery may be made by instalments. b) Delivery is only to the British Mainland and does not include Northern Ireland, Channel Islands or Isle of Man We regret that at this time we can only accept orders to be shipped to the UK. c) The majority of items that we offer for sale are carried in stock. Once an order is placed, you will by contacted by one of our sales advisors by telephone within 48 hours to arrange delivery. Please be advised that we will not deliver goods until we have contacted you to confirm stock availability and arrange a convenient date for delivery. d) All orders are shipped by insured APC courier. Deliveries are on weekdays between 9am and 6pm. You or your representative must be at the address to sign for the goods on the day of delivery. e) Saturday deliveries may be possible but only by prior arrangement and at an additional cost to you. If you wish to arrange a Saturday delivery please mention this to your sales advisor when we contact you. f) Should you be out when the courier calls, the driver will leave a card to let you know they have attempted delivery. They will then take the order back to YOUR local depot. You can arrange collection from your local depot by calling the number on the APC card. To find the location of your nearest APC depot please visit www.apc-overnight.com and select the 'location' option, enter your postcard and click 'submit'. g) If delivery of your goods is not rearranged or goods are not collected from APC within 48 hours of the original attempted delivery, the goods will be returned to us for restocking and your order will be cancelled. Should this occur, a fee of £25 will be charged to your credit card to cover our delivery and administration costs. h) We can ONLY deliver goods to the credit card holders registered address (e.g. the address the bills are sent to).
14) TITLE & RISK a) Title to Product does not pass until full payment in cash or cleared funds have been received for all goods and services delivered to the buyer under this and all other contracts between the seller and the buyer. Until then the customer must insure and store the goods separately and may not modify, pledge or sell them. b) PCI may enter the storage premises to repossess the goods at any reasonable time specified by PCI until full payment has been received. Should the customer sell them before title passes, they will become PCI agent and the proceeds of the sale shall be held on our behalf, separately from the customer's general funds. PCI may sue for the Price before title passes. c) If the customer refuses delivery without PCI agreement, the customer must pay PCI expenses or losses resulting from that refusal, including storage costs, until the customer accepts delivery. d) As soon as we have delivered the goods to your door and you have signed for their receipt, you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk.

Terms and Conditions (.ext) 15) DAMAGE & SHORTAGES a) On receipt of the goods, please make sure that you examine them fully. It is your responsibility to check the goods upon delivery for shortages or damage and to make a note of such on the carriers consignment note when you sign for the goods. b) In any event all damages must be reported to PCI, in writing, with 72 hours of delivery taking place. c) It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 72 hours from delivery. d) If we supplied you with a product other than ordered it is your responsibility to notify us of any incorrect goods supplied within 7 days from delivery. PCI will not accept liability for goods lost in transit unless we are notified within 7 days from the expected delivery date. If goods returned under this clause are found to be perfect and in full working order, these will be returned to you and an administration fee of 15% of the price of the goods along with the cost of carriage will be charged to your credit card account. e) PCI shall not, in any circumstances, be under any liability to the buyer in respect of indirect or consequential loss or damage ,or loss of profits.
16) COLLECTIONS a) If you are collecting goods from PCI that have been ordered on-line you MUST bring your credit card with you when you collect, along with suitable identification (e.g. utility bill, passport, drivers licence). Your card will NOT be charged when you order on-line but will be charged when we swipe your card on collection. There are NO exceptions to this rule.
17) SOFTWARE a) Software not owned by PCI is supplied subject to the licence and warranty of the Software licensor. PCI encloses the Software licence that the customer requires with the Product where necessary; you must comply with that licence.
18) YOUR RIGHT TO CANCEL a) Under the terms of the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel your order within 7 working days following the day after the date of delivery and return the goods supplied to us for a full refund. You must notify us in writing during this period of your intention to cancel by writing to us at the address below: Cancellations Department PC Interworks Ltd 1 Prospect Way Victoria Business Park Knypersley Stoke on Trent ST8 7PL b) Providing the goods are returned in the condition described below, you will receive a full refund, less any of the charges outlined below, within 30 days of you giving us your notice to cancel. We are unable to accept back goods for a credit if they are unwanted gifts or non-faulty items 7 working days after the purchase date.
19) REFUNDS & RETURNS POLICY a) Upon receipt of your written notification, we will issue you a returns authorisation (RAN) number that you must quote on the paperwork when returning the goods. You must organise the return the unwanted items at your expense and risk. b) Goods must be returned to our Returns Department within 7 working days from authorisation. We are unable to accept returns of un-wanted and non-faulty items after the 7 working days. Any 'FREE GIFTS' with the products must also be returned. c) Full refund of the cost of the goods is wholly conditional upon the above conditions being met and the refund authorised only after a full inspection of the goods by our Returns department to check for completeness and correct product return. d) Where goods are received back complete as NEW and unused and in original box and packaging including all accessories and in a re-saleable condition, you will be refunded the full invoice amount less cost of delivery. e) Where goods are received back complete as NEW and unused and in original box and packaging but with accessories missing, you will be refunded the full Invoice price less delivery charges and cost of accessories as notified to you. f) Where goods are received back not in a re-saleable condition, we will be unable to accept these back under the above terms and the goods will be returned back to you and the cost of delivery charged to your account. g) We are unable to accept returns of opened box software or if the goods were a special order to the customer's specification or products with contract services that have been connected (i.e. mobiles). h) Please return items under the above policy to: Returns Department PC Interworks Ltd 1 Prospect Way Victoria Business Park Knypersley Stoke on Trent ST8 7PL i) Returns cannot be accepted without prior authorisation and a returns authorisation number. Please ensure that you mark the item or items that you are returning with the returns authorisation number that has been issued to you. j) The returns authorisation is valid for up to 7 working days only. Goods sent back without prior returns authorisation will be returned back to you and the cost of delivery charged to your account.
20) GUARANTEE a) All Grade 2 products are supplied guaranteed for a minimum period of six months following the date of delivery. b) All New consumer products are supplied guaranteed for a minimum period of one year following the date of delivery. c) All products supplied are covered by the terms and conditions of the manufacturers guarantee. This guarantee specifically excludes faults caused by accident, neglect, and misuse. In addition routine maintenance, consumables, cosmetic damage and initial or subsequent setup are not covered. Product Guarantees - TFT LCD Monitors and Televisions d) TFT displays are made up of thousands of pixels. For example, a 15" flat-screen with a resolution of 1024 x 768 has 786423 pixels. Each pixel comprises of three sub-pixels (red, green and blue) making almost 2.4 million dots. Behind each pixel is a transistor. When a transistor fails it manifests itself as a bright, dark or coloured dot on the screen that stands out from the rest. e) Today's production techniques unfortunately cannot guarantee an absolutely fault-free screen display and buyers should be aware of the possibility of imperfections (in the form of a few isolated constantly lit or unlit pixels) before choosing to purchase a TFT monitor or television. f) Due to this, there is indeed a commonly accepted 'tolerance level' by which TFTs may display such imperfections (or stuck pixels) without being classified as faulty. As such, we can only take back displays as faulty for refund/repair if the number of stuck pixels exceeds the manufacturer's guidelines. The number required for the monitor or television to be classed as faulty does vary between manufacturers. Please check with the relevant manufacturer as to their 'tolerance level'
21) AFTER SALES SERVICE a) All Grade 2 Fujitsu Siemens products (1) If you experience problems with a product within the first 28 days after delivery, please call 01782 375480 (Option 3 for Technical Support) and one of our technical advisors will assist you. (2) If you experience problems with a product after the first 28 days after delivery, please call Fujitsu Services on 08705 353325 and one of their technical advisors will assist you. b) All New Fujitsu Siemens consumer products (1) If you experience problems with a product within the guarantee period, please call Fujitsu Services on 08705 353325 and one of their technical advisors will assist you. c) All other New consumer products (1) If you experience problems with a product within the guarantee period, please call the number listed on the enclosed manufacturers documentation and one of their technical advisors will assist you.
22) LIABILITY a) PCI liability in respect of defects in the goods shall be limited to those stated in Clause 21 and subject to Clause 2(1) of the Unfair Contract Terms Act 1977, PCI shall not be liable whether in contract or in tort, including but not limited to negligence, or by reason of breach of statutory duty or otherwise, for any damage or loss whatsoever suffered by the buyer arising out of or attributable to such defects. b) Neither party shall be liable to the other for any indirect or consequential loss or damage, loss of profit, loss of use or production or of contracts which the other may suffer arising out of any breach by a party of its obligations under the contract and whether the same be due to the negligence of that party or not.
23) PRIVACY POLICY a) PC Interworks/buyit247.net does not disclose buyers information to third parties. Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' option.
24) COMPLAINTS a) Any complaints regarding the goods or services supplied should be made to the address below. 25) FORCE MAJEURE: a) PCI is not liable for delays in performance (incl. delivery or service) caused by circumstances beyond its reasonable control and will be entitled to a time extension for performance; examples include strikes, supplier/transport/production problems, exchange fluctuations, governmental or regulatory action and natural disasters. If this lasts more than 2 months, this Agreement may be terminated by either party without compensation.
26) CONFIDENTIALITY a) Each party must treat all information received from the other marked "confidential" or reasonably obvious to be confidential as it would treat its own confidential information.
27) YOUR OBLIGATIONS AS A CUSTOMER a) You are responsible for your own choice of Product and its suitability for purpose and your telephone & postal charges in contacting PCI, if any. The customer must provide PCI with all reasonable courtesy, information, cooperation, facilities and access to enable PCI to perform duties, failing which PCI shall not be obliged to perform any service or assistance. The customer is responsible for the removal of non PCI supplied products during service, the back up and confidentiality of all data in product.
28) CONSUMER RIGHTS a) Any statutory Consumer rights are unaffected by this Agreement.
29) MISCELLANEOUS a) If any part of the Agreement is found to be invalid or unenforceable by a court, the rest is unaffected. PCI may subcontract its obligations to a third party. Otherwise, neither party may assign or transfer any obligations or rights. All notices must be in writing (by hand, email, fax or 1st class post deemed delivered 48 hours after posting) and sent to a legal officer of either party.
30) JURISDICTION a) The Contract shall be governed by and construed in accordance with English Law and the parties hereby submit to the non-exclusive jurisdiction of the English Courts. |
